Terms and Conditions


DEFINITIONS
Arrival: the start date of the period for which the Agreement between Holidaymaker and Recreatiepark De Wielen B.V. has been entered into.
Accommodation: all recreational accommodation for recreational purposes. (Bungalows, chalets and group accommodation)
Accommodation provider: the owner of the Accommodation to be rented out.
General Terms and Conditions: these terms and conditions that apply to all Agreements concluded for the rental of an Accommodation from an Accommodation Provider between Holidaymaker and Recreatiepark De Wielen B.V.
Recreatiepark De Wielen: Recreatiepark De Wielen B.V. is the owner, rental agent and manager of the Park. Hereinafter referred to as 'Recreatiepark De Wielen'.
Facilities: all facilities within or outside the Park that can be used on the basis of the Agreement.
Guests: all persons who fall under the definition of Holidaymaker and Fellow Holidaymaker and use the Accommodation and/or Facilities at the Park, as well as visitors to the Park.
Fellow Holidaymaker: the persons who are registered by the Holidaymaker at the time of booking and/or who are part of the travel group. This is indicated at the bottom of the reservation confirmation.
Agreement: the Agreement for the rental of an Accommodation with the associated General Terms and Conditions.
Park: the Park in which an Accommodation is located, namely Recreational Park De Wielen located at Killemerweg 2, 1744 KP in Sint Maarten North Holland.
Park regulations: the regulations that Recreatiepark De Wielen applies to the Park.
Holidaymaker: the (legal) person who makes the booking and enters into the Agreement.
Stay Sum: the rental price for the Accommodation including any discounts and excluding any additional costs.
In writing: by letter, e-mail, text message, WhatsApp or via the Recreatiepark De Wielen app.
Sales channels: Recreatiepark De Wielen uses multiple sales channels such as Booking.com, Airbnb, Homeaway, etc.
Deposit: an amount that can be charged as an advance on any damage / additional cleaning work caused during the stay by (the actions of) the Guest. Any outstanding items can also be offset against the Deposit. The Deposit will be refunded within 7 days after departure, provided that the account number of the Holidaymaker is known and no damage as indicated above has been found.
Website: the website(s) of Recreatiepark De Wielen that was used to conclude the Agreement. Where a definition is formulated in the singular, it also applies to the plural and vice versa.


APPLICABILITY OF GENERAL CONDITIONS
These General Terms and Conditions apply to all Agreements between Recreatiepark De Wielen and Holidaymaker regarding the rental of Accommodations. These conditions are an inseparable part of the Agreement.

CONCLUSION OF AGREEMENT AND RESERVATIONS
An Agreement for the rental of an Accommodation is concluded through offer and acceptance. An Agreement can only be entered into by a Holidaymaker who is 21 years or older. If the Holidaymaker is younger than 21 years old, Recreatiepark De Wielen may impose additional conditions. If the Holidaymaker's Co-Recreers are younger than 21 years of age, the Holiday-maker must accompany those Co-Recreers during the entire stay of those Co-Recreers.
An Accommodation can be reserved online. This method of reservation is binding for both parties.
Book online:
* An Agreement is concluded if:

  1. the Holidaymaker agrees to these General Terms and Conditions;
  2. the Holidaymaker completes all mandatory information to make the reservation online and then finalizes the reservation by means of: the button “place your booking”, and;
  3. Recreatiepark De Wielen has confirmed the reservation to the Holidaymaker in Writing.

* Every receipt of a reservation made via the Website or one of our Sales Channels is confirmed by an e-mail to the Holidaymaker. This means that the reservation has been received and is being processed. The reservation is therefore binding for the Holidaymaker.
* If the Holidaymaker has not received a confirmation of receipt by e-mail, something may have gone wrong with the booking and the Holidaymaker must contact Recreatiepark De Wielen, as the reservation cannot yet be claimed.
Reservation confirmation
After checking and processing the reservation, the Holidaymaker will receive a booking confirmation from Recreatiepark De Wielen by e-mail. If this booking confirmation is not received within 24 hours of booking, the Holidaymaker must contact Recreatiepark De Wielen, otherwise the Holidaymaker cannot make a claim on the reservation. Any inaccuracies in the reservation confirmation must be reported to Recreatiepark De Wielen within 48 hours.
Right of withdrawal
Reservations made are irrevocably binding for the Holidaymaker. A right of withdrawal (the so-called cooling-off period) as referred to in the Civil Code does not apply to services relating to the rental of Accommodations.
Recreational

  • The Holidaymaker must be at least 21 years old at the time of booking.
  • The Holidaymaker is liable for all Fellow Holidaymakers who are registered and who accompany him/her and for all Guests who visit the Holidaymaker at the Park.
  • All correspondence is conducted via the Holidaymaker's details.


CANCELLATION OR MODIFICATION OF THE AGREEMENT
Cancellation by Holidaymaker

It may happen that one has to cancel the stay due to unforeseen circumstances. In this case, the Holidaymaker or his deputy must inform Recreatiepark De Wielen in writing. In most cases, costs are associated with a cancellation or change. After cancellation, the Holidaymaker will receive a cancellation invoice from Recreatiepark De Wielen. This describes the costs of the cancellation. Recreatiepark De Wielen applies the following cancellation conditions:

  • If you cancel within 48 hours of booking, no costs will be charged. You will get your deposit back in full.
  • if canceled after 48 hours and 60 days before arrival, 25% of the total stay sum will be charged. (This is equal to the deposit paid during the reservation.)
  • If you cancel between 60 and 30 days before arrival, 50% of the total stay sum will be charged.
  • If you cancel within 30 days before arrival, 100% of the total stay amount will be charged.

 
Cancellation by Recreatiepark De Wielen
In the event of force majeure or unforeseen circumstances, Recreatiepark De Wielen is entitled to cancel the reservation. Unforeseen circumstances and force majeure include:

  • That the Accommodation is no longer suitable for rental (for example: due to flooding, fire or breach of contract by the Accommodation Provider).
  • That the Accommodation is no longer available (for example due to the sudden sale of the Accommodation by the Accommodation Provider, a double placed reservation or bankruptcy of the Accommodation Provider).

Recreatiepark De Wielen will immediately inform the Holidaymaker of this in Writing, stating the reason. In this case, he will try to offer equivalent Accommodation for the same Travel Price. If no suitable alternative offer can be made, or the Holidaymaker does not agree with the alternative offered, Recreatiepark De Wielen will refund the Accommodation Sum already paid in full or in part without Recreatiepark De Wielen owing the Holidaymaker any compensation.
Modify
If a Holidaymaker wants to change an Agreement, this is possible up to 30 days before Arrival. After changes, the booking may not be cheaper than the original booking. Change fees may be charged for these changes.
Substitution
If the reservation is completely transferred to a third party, the Holidaymaker must notify De Wielen Recreation Park in writing. Change costs will be charged for these changes.
Amounts already paid will be deemed to have been paid by the acquiring party. The transferring and acquiring parties must arrange this mutually.

FINANCIAL PROVISIONS

Pay
When booking online, 50% of the total Stay Sum must be paid online. You will immediately receive the reservation confirmation by e-mail. The remaining amount must be received by Recreatiepark De Wielen 60 days before arrival. If you have paid the deposit by credit card, the remaining amount will be automatically debited 60 days before Arrival. If you have paid the down payment with Ideal, you will receive a payment request 10 weeks before arrival. You then have 14 days to make this payment. The total amount of the Accommodation Sum must always be paid in full before Arrival.
Failure to pay within the payment term
If Recreatiepark De Wielen has not received payments on time, it is entitled to dissolve (cancel) the Agreement and hold the Holidaymaker liable for the cancellation costs. The cancellation costs will be deducted from the amounts already paid.

OBLIGATIONS FOR RECREATIONERS AND (FELLOW) RECREATIONERS
The Holidaymaker and Fellow Holidaymaker and any Guests they may have will comply with the obligations under these General Terms and Conditions and the Park Regulations. Failure to comply with these obligations will be regarded as an attributable shortcoming in the fulfillment of the Agreement, which leads to liability for damages on the part of the Holidaymaker towards Recreatiepark De Wielen. Furthermore, this gives De Wielen Recreation Park the right to terminate the Agreement.

(USE) ACCOMMODATION
Condition of the Accommodation and nature of use

  • The Accommodation is made available to the Holidaymaker in good condition. If the Holidaymaker is of the opinion that this is not the case, he must immediately report this to Recreatiepark De Wielen.
  • The Holidaymaker is obliged to treat the Accommodation and the associated inventory with care. The holidaymaker will leave the rented property in a tidy condition upon departure. All damage caused to the Accommodation by the Holidaymaker or Co-Recreant must be reported to Recreatiepark De Wielen by the Holidaymaker before departure and must be paid for before departure.
  • If the Accommodation is not left clean or damaged or if inventory is missing, Recreatiepark De Wielen is entitled to recover the damage from the Holiday Maker. If applicable, this can be offset against the deposit. If no deposit applies, the damage will be recovered directly from the holidaymaker or via the sales channel used.
  • The Accommodation may only be used by the Holidaymaker for recreational purposes, unless expressly agreed otherwise in Writing. Recreational purposes in any case do not include the use by the Holidaymaker of the Accommodation during the period that one or more of the users of that Accommodation(s) is carrying out work, regardless of whether these are paid or unpaid and regardless of whether they take place in employment or outside employment. Permanent residence is not permitted.
  • Employees of Recreatiepark De Wielen have access to The Accommodation at all times for maintenance and/or emergencies in and around The Accommodation.


Maximum persons allowed

The use of the reserved Accommodation with more than the number of persons stated in the reservation confirmation is not permitted. In this case, Recreation Park De Wielen can deny the (Co-)Recreant the use of the Accommodation. This person is not entitled to a refund. It is not permitted to receive visitors or allow them to stay overnight without prior approval from Recreation Park De Wielen.

Pets
Pets are only allowed if this is explicitly stated.

  • Registering pets after the reservation will be considered a change.
  • Bringing pets without registration may be a reason for De Wielen Recreation Park to refuse access to the Park and/or the Accommodation.
  • There are additional (cleaning) costs associated with bringing pets.
  • Pets must at all times demonstrably meet the health and vaccination requirements. Failure to meet these requirements or the inability to demonstrate that these requirements are met may be a reason for De Wielen Recreation Park not to allow the pet into the Accommodation or the Park. The Holidaymaker is and remains liable at all times for damage caused by the pet to the Accommodation or the Park.


FACILITIES (IN OR OUTSIDE THE PARK)
Opening hours
In the description of the Accommodation on the Website, information is provided about the Facilities offered, including opening hours.

ACCOMMODATION INFORMATION
Arrival and departure

You can find the times of arrival and departure in the reservation confirmation. You can also find this information on the Website. In the event of late arrival or early departure, the costs for the entire reserved period remain due.

COMPLAINTS

If a Guest has a complaint during their stay at the Park, this can be reported in Writing to the Park manager in order to give Recreatiepark De Wielen the opportunity to resolve this complaint. If the complaint has not been resolved satisfactorily, the complaint can be submitted in writing to Recreatiepark De Wielen up to 14 days after returning home. This must include the complaint, any booking number, the contact details of the Guest and any other information that may be useful to Recreatiepark De Wielen in handling the complaint.

STAY SUM AND COSTS

  • A combination of discounts is not possible.
  • Recreatiepark De Wielen reserves the right to change the Accommodation Sum if an increase in government levies or taxes gives reason to do so.
  • Any discount promotions do not apply to existing/already made Reservations.


LIABILITY

  • Recreatiepark De Wielen and Accommodation Provider are not liable for loss and/or theft (including money), damage to property, damage or injury caused to the (Co-)Recreant for whatever reason.
  • The use of the Accommodation and all Facilities and services at the Park is at the (Co-)Recreant's own risk.
  • Recreatiepark De Wielen accepts no liability for (unexpected) (construction) activities in the vicinity of the reserved Accommodation, work on access and/or main roads, noise pollution from, for example, neighbors, church bells, fireworks, cars, trains or agricultural equipment, nuisance from vermin and environmental problems in the vicinity of the Park and/or the Accommodation. 
  • The (Co-)Recreant is expected to be aware of local laws and regulations. Recreatiepark De Wielen is not liable for the consequences of any violation thereof by the (Co-)Recreant.


Liability Holidaymaker
During the stay, the Holidaymaker is liable for damage caused during the stay to the Accommodation, the furnishings and all items belonging to the booked Accommodation, regardless of who caused the damage. The settlement of this damage must initially take place between Recreatiepark De Wielen and the Holidaymaker.

PRIVACY
You will receive a reference to the privacy statement of Recreatiepark De Wielen in your reservation confirmation and can be found on the website.

APPLICABLE LAW AND JURISDICTION
Dutch law applies to the Agreements concluded, amended or supplemented on the basis of these General Terms and Conditions, unless other law applies based on mandatory rules.
Disputes regarding the Agreement can only be submitted to the competent court in North Holland. If the Holidaymaker is a natural person who is not acting in the exercise of his profession or business, the Holidaymaker will be granted a period of at least one month after Recreatiepark De Wielen has invoked this provision in Writing, to submit the written request for settlement of the dispute. to choose a competent court according to the law.

  • The Holidaymaker is responsible for providing the correct contact details and must immediately report any change in his contact details to Recreatiepark De Wielen.
  • Dutch law applies to the Agreements concluded, amended or supplemented on the basis of these General Terms and Conditions, unless other law applies based on mandatory rules.
  • Disputes regarding the Agreement can only be submitted to the competent court in North Holland. If the Holidaymaker is a natural person who is not acting in the exercise of his profession or business, the Holidaymaker will be granted a period of at least one month after Recreatiepark De Wielen has invoked this provision in Writing, to submit the written request for settlement of the dispute. to choose a competent court according to the law.
